USED VEHICLE RETURN POLICY & AS-IS DISCLOSURE

MISSOURI MARINE AND AUTO SALES

ALL SALES ARE FINAL

All used motor vehicles sold by Missouri Marine and Auto Sales are sold AS IS, WHERE IS, WITH ALL FAULTS, unless a separate written warranty or service contract is specifically provided and signed by the dealership and purchaser.

NO RETURN OR BUYER'S REMORSE PERIOD

Missouri Marine and Auto Sales does not offer a return, exchange, or cancellation period for used vehicle purchases based solely upon a purchaser's change of mind, dissatisfaction after purchase, or "buyer's remorse."

Once the purchase documents have been signed and the vehicle has been delivered to the purchaser, the sale is considered final, subject only to rights and remedies that cannot legally be waived or excluded under applicable law.

Missouri law does not provide a general "cooling-off" or buyer's-remorse period for automobile purchases. A purchaser may not return a vehicle simply because they subsequently decide they do not want the vehicle, discover they prefer a different vehicle, or determine that the vehicle does not meet their personal expectations.

AS-IS SALE

The purchaser acknowledges that the vehicle is a USED MOTOR VEHICLE and may have existing, unknown, or undiscovered mechanical, electrical, cosmetic, structural, or other defects.

The purchaser acknowledges that they have had the opportunity to:

  • Inspect the vehicle;

  • Test drive the vehicle;

  • Have the vehicle inspected by a mechanic or other qualified person of their choice;

  • Review available vehicle history and condition information;

  • Ask questions concerning the vehicle; and

  • Satisfy themselves as to the vehicle's condition, value, history, and suitability for their intended use.

The purchaser accepts the vehicle in its condition at the time of sale and assumes responsibility for repairs, maintenance, and other ownership expenses after delivery, except as otherwise expressly provided in a separate written agreement or required by law.

NO IMPLIED WARRANTY

To the fullest extent permitted by Missouri law, all implied warranties are excluded, including any implied warranty of merchantability or fitness for a particular purpose.

The vehicle is sold "AS IS" and "WITH ALL FAULTS."

No verbal statement, representation, promise, or assurance by any salesperson, employee, or other representative shall create a warranty unless such warranty is specifically included in a written agreement signed by an authorized representative of Missouri Marine and Auto Sales.

NO GUARANTEE OF FUTURE CONDITION

The dealership does not guarantee that a used vehicle will remain in the same mechanical or cosmetic condition after delivery.

Normal wear and tear, maintenance requirements, mechanical failure, warning lights, breakdowns, or repairs that occur after delivery do not create a right to return the vehicle or receive a refund unless otherwise required by applicable law or expressly covered by a separate written warranty or service contract.

INSPECTIONS AND TEST DRIVES

Purchasers are strongly encouraged to have any used vehicle independently inspected by a qualified mechanic before completing the purchase.

A purchaser's decision not to obtain an independent inspection does not create a right to cancel or unwind the sale after delivery.

The purchaser's signature on the purchase documents acknowledges that the purchaser had the opportunity to inspect and test drive the vehicle and accepts the vehicle in its condition at the time of sale.

FINANCING

If the vehicle is purchased through financing, the purchase remains subject to the terms of the applicable retail installment contract, finance agreement, and other signed documents.

A purchaser's dissatisfaction with the vehicle after delivery does not, by itself, cancel or terminate the purchaser's financing obligations.

TRADE-INS

Once a trade-in has been accepted and the transaction has been completed, the trade-in is considered part of the completed transaction. The purchaser may not demand the return of the trade-in or cancellation of the transaction solely because the purchaser later changes their mind about the vehicle purchased.

EXCEPTIONS REQUIRED BY LAW

Nothing in this policy is intended to waive, eliminate, or limit any right, remedy, warranty, disclosure requirement, or other protection that cannot legally be waived or limited under applicable Missouri or federal law.

If a separate written warranty, service contract, or other written agreement applies to the vehicle, the terms of that agreement control to the extent of any conflict with this policy.
